Agreement
Section 1
Any purchase made by the buyer is final; there will be no returning of the vehicle unless one of the following instances occurs.
A. The vehicle has suffered serious accident damage, which was not made apparent to the buyer and was not described as having so by Direct Car Auction.
B. The vehicle is an insurance loss claim.
C. Has had its mileage reading altered or tampered with in any way. This is providing that Direct Car Auction have given warranty to the mileage reading in description.
D. The vehicle is found to have a major mechanical defect in its engine, gearbox or transmission, which was not described to the buyer by Direct Car Auction.
E. Has major exterior damage not disclosed by Direct Car Auction.
F. Has major interior damage or wear, which Direct Car Auction did not state.
As both a buyer and a seller you have a responsibility to Direct Car Auction.
A. You must provide us with your address for delivery, collection and also invoicing.
B. You must ensure that you have sufficient funds in your account to cover any costs encountered.

A. All cars listed on the Direct Car Auction web site are for sale from the moment that the auction starts to the moment that it finishes.
Complaints procedureIn the event of a car being mis-described as referred to the earlier section Direct Car Auction will be more than willing to deal with the complaint seriously. In order to do this you will need to put your complaint in writing either over the fax or by letter; however there is a strict period of 24 hours only in which you have to raise any queries about a given vehicle with us. This limit will come into force from the time that the car is delivered to you.
Important pointsA. An £90 Indemnity fee is charged with each vehicle purchased this charge is protection or insurance against possible loss caused by any outstanding finance, it passes the title of the car and covers you for any that are on the total loss register.
B. Value added tax is payable on all CHARGES (e.g. delivery costs, etc.)
C. All aspects of Direct Car Auction are governed by British law.
Section 2 Direct Car Auction Terms
As a vendor you have a responsibility to Direct Car Auction. Direct Car Auction sells as an agent for the vendor. As the vendor you are responsible for taking any retail vehicles off sale 48 hours before that start of a Direct Car Auction sale. Any Vehicle entered into a sale is available to Direct Car Auction 48 hours before a sale. If you, as the vendor break, this agreement Direct Car Auction are entitled to carry out one or more of the rights or remedies listed on the following page (section 2,1.1 to 1.8), or any other suitable remedy.
The seller warrants to Direct Car Auction that he or she is the true owner of the vehicle or that he has the necessary authority to sell the vehicle through Direct Car Auction. In the event that Direct Car Auction suffer any loss or damage in consequence of the seller breaching contract then the seller will be responsible for covering the cost of these damages.
Direct Car Auction reserve the right to refuse anybody admission to their auction. Direct Car Auction reserve the right to refuse any bid without giving any kind of explanation. The seller shall be entitled to place a reserve bid on any lot, which will be subject to the discretion and approval of Direct Car Auction. Where a reserve bid has been placed, only Direct Car Auction may bid on behalf of the seller. Where no reserve has been placed, the seller may bid either personally or through the agency of any one person. Direct Car Auction has the right to refuse any bid, which does not exceed the previous bid by a proportion set by Direct Car Auction in their absolute discretion.
The highest bidder shall be the buyer, any dispute as to the bid shall be settled at Direct Car Auction's absolute discretion. Every bidder shall be deemed to act as a principal unless there is in force a written acknowledgement by Direct Car Auction that he or she acts as an agent on behalf of a named principal.
Ownership of the lot shall not pass to the buyer until he or she has made payment in full to Direct Car Auction of the purchase price plus indemnity. The buyer of any motor vehicle is responsible for complying with all legal requirements as to the construction and use of that vehicle and for obtaining all certificates, permits or other authorisations necessary before that vehicle can be used on any road. If any lot is not paid in full, and accepted in accordance with these terms and conditions or there is any breach of these conditions then Direct Car Auction has the right to exercise one of the following rights or remedies, that is to say that:
1. To proceed against the buyer for damages for breach of contracts.
2. To rescind the sale of that or any other lot sold to the defaulting buyer at the same or any other auction.
3. To resell the lot or cause it to be resold by public auction or private sale. The defaulting buyer shall then pay to Direct Car Auction any resulting deficiency in the purchase price at the first auction after deduction of any part payment and additional of resale costs. Any surplus shall belong to the seller.
4. To remove, store (either on Direct Car Auction premises or elsewhere) and insure the lot at the expense of the defaulting buyer.
5. To charge interest at a rate not exceeding 2% per month on the purchase price to the extent that it remains unpaid for more than 2 working days after the day of the auction.
6. To retain that or any other lot sold to the same buyer at the same or any other and release it only after payment of the purchase price.
7. To reject or ignore any bids made by or on behalf of the defaulting buyer at any future auction or to obtain a deposit for accepting any bids in future.
8. To provide any of the proceeds of sale then due or at any time afterwards becoming due to the defaulting buyer towards settlement of the purchase price and to exercise a lien on any property of the defaulting buyer which is in Direct Car Auction possession for any purpose.
In all cases, the lot shall remain the same at all times at the risk of the seller and neither Direct Car Auction nor our servants or agents will be responsible for any loss of damage whether caused by negligence or otherwise whilst in their possession. Direct Car Auction will remit the proceeds of the sale to the seller no later than 3 working days after the sale.
Direct Car Auction has authorisation from the seller to deduct commission or any other charge plus any VAT payable. If any lot is not sold the seller will be notified immediately and will be able to make arrangements for the lot to be re-entered.
